Privacy Statement Introduction
pfsSoftware assumes that users of any pfsSoftware owned web site and pfsSoftware owned retail software products are businesses and or persons engaged in the selling of travel related products and services. All pfsSoftware owned web sites and retail software products are to be used for business purposes only. pfsSoftware web sites and pfsSoftware retail software products should not be used for personal use nor should they be used by persons under the age of 18. pfsSoftware and affiliates respect your preferences concerning the treatment of personal information that we may collect from your use of any pfsSoftware owned Web Site and any pfsSoftware retail software product. Currently, pfsSoftware owns and operates the Web Sites addressed at www.cruisepak.com and www.cruisepak.net. pfsSoftware publishes a retail software product suite titled CruisePak; which is used by businesses engaged in the selling of travel related products and services. This policy lets you know how we collect and use your personal information, and how you can control its use. This policy describes the broadest potential use of personal information throughout the pfsSoftware owned Web Sites and pfsSoftware owned retail software products. We may make far less use of personal information than we have outlined in this policy. Personal Information We Collect And How It Is Collected pfsSoftware collects personal information, such as your e-mail address, name, home or work address or telephone number. We may also collect demographic information, such as your ZIP code, age, gender, preferences, and professional affiliations. Information collected on pfsSoftware owned web sites may be combined with information obtained from other pfsSoftware services and other companies. If you choose to sign up for a paid subscription service (such as CruisePak or CruisePak API), we will collect information, such as your credit card number and billing address, only if your payment method requires provision of that information, which is then used to create a pfsSoftware billing account. We collect information about your visit, including the pages and advertisements you view, the CruisePak Product Serial number, the links you click and other actions taken in connection with the usage pfsSoftware web sites, retail software products, and services, and. We also collect certain standard information that your browser sends to every website or service you visit, such as your IP address, browser type and language, access times and referring Web site addresses. Some pfsSoftware products and services may be co-branded and offered in conjunction with another company. If you register for or use such services, both pfsSoftware and the other company may receive information collected in conjunction with the co-branded services. pfsSoftware DOES NOT collect any information about your retail customers, contacts, vendors, or any business information, including financial data contained within the CruisePak Product database(s). Cookies: In addition to the information specified above, pfsSoftware may collect information about your use of the pfsSoftware owned Web sites through cookies. pfsSoftware may automatically receive personal information from you as part of the communication connection itself, which often consists of network address information, hardware information, browser type, and date and time. pfsSoftware does not utilize third party cookies. Uniform Resource Locator (URL) Parameters: pfsSoftware also uses a tracking technique that employs codes as parameters to URL specifications. This allows use of the site without cookies. URL parameters allow information to follow you from URL to URL, as you navigate the site. This tracking technique expires when you leave the site. Personal information collected on this site is stored and processed in the United States. Use And Sharing Of Information To Engage in Transactions. pfsSoftware may use personal information such as name, physical address, telephone number, email address, and company to engage in transactions with you, including contacting you about your order. To Process Transactions. pfsSoftware may use financial/credit card and payment information to process your order. pfsSoftware may need to share some of this information with appropriate credit card companies as necessary to complete the transaction. To Provide Support or Other Services. pfsSoftware may use your personal information to provide you support or other services you have ordered, as well as product updates, and other product oriented communications. To Provide Information To Advertisers. pfsSoftware may provide personally identifiable information to businesses that advertise on pfsSoftware owned Web Sites and in pfsSoftware owned retail software products. Businesses that advertise on pfsSoftware owned websites and retail products have a privacy policy equal to or stronger than pfsSoftware's privacy policy. We only provide information to those advertisers whose messages you have seen. The information we may provide is Business Name, Address, Telephone Number, and Email Address. To Tailor Marketing. pfsSoftware may use your personal information to provide you with notices of new product releases and service developments. pfsSoftware also may use your personal information to respond directly to your requests for information, including registrations for newsletters or other specific requests, or pass your contact information to the appropriate pfsSoftware reseller to respond to your request. To Comply With Legal Requirements. pfsSoftware may access and/or disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on pfsSoftware, (b) protect and defend the rights or property of pfsSoftware, or (c) act in urgent circumstances to protect the personal safety of users of pfsSoftware services, affiliated suppliers, or members of the public. Opting Out Email Message Opt Out. pfsSoftware enables you to Opt Out of receiving Email communications in accordance with Senate Bill S.877, Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 (CAN-SPAM Act of 2003). Unsubscribing according to the method defined in any email communication sent by pfsSoftware stops you receiving any future email communications from pfsSoftware. Non-Marketing Communications Not Subject To Opt-Out. Some non-marketing communications are not subject to general opt-out, such as communications related to product download, sales transactions, software updates, support related information, and disclosures to comply with legal requirements. Other Communications Not Subject To Opt-Out. pfsSoftware does not provide you the ability to opt out of our contracted requirement of sending personally identificable information about you to businesses that advertise on pfsSoftware owned Web Sites and in pfsSoftware owned retail software products. If you do not wish this information to be sent to businesses that advertise with us, then you should not use any pfsSoftware owned web site or pfsSoftware owned retail product. Security The security of your personal information is very important to pfsSoftware. We have in place physical, administrative and technical safeguards designed to protect your personal information from unauthorized access. In addition, pfsSoftware uses standard security protocols and mechanisms to exchange the transmission of sensitive data such as credit card details if transactions so require. In the event that your personal information is acquired, or is reasonably believed to have been acquired, by an unauthorized person and applicable law requires notification, pfsSoftware will notify you of the breach by email. pfsSoftware will give you notice promptly, consistent with the reasonable needs of law enforcement and/or pfsSoftware to determine the scope of the breach and to investigate and restore the integrity of the data system. Privacy Policy Updates We may update this policy from time to time. We will post a prominent notice in this section of this policy notifying users when it is updated. If we are going to use your personal information in a manner different from that stated at the time of collection, we will notify you via email, and you will have a choice as to whether or not we use your personal information in this different manner.
